1 This action was commenced by defendant in error, as Plaintiff, against plaintiffs in error, as defendants, to recover damages for the wrongful death of plaintiffs 19-year-old daughter, Sue Ann Whitaker, a sophomore student in Oklahoma University, from being struck and run over by a diesel trailer-truck between 4:00 and 5:00 A.M., January 27, 1957, on Highway No. 9, about 9 miles east of Eufaula, Oklahoma. The parties will hereinafter be referred to as they appeared in the trial court.
